Welcome to Atelier 83 a interior design service which consists of various packages of electronic design and tailor-made services, thanks to which you can find the right interior design according to your requirements from the comfort of your home.
We hope you enjoy using Atelier 83 and keep your family, friends, and colleagues informed!
These Terms of Service (the "Terms") - including our Privacy and Cookie Policy, the GDPR Statement and the Website Policy - set out the terms between us for using Atelier 83 our virtual interior design service.
Please note that these Terms do not apply to interior design services to be provided on or for commercial or commercial premises. If you have such requirements, please contact us so that we can discuss your requirements in more detail.
These Terms and Conditions are concluded between:
(1). "Atelier 83", its representatives, employees and suppliers; and
(2). You - any person who orders and pays for the services is referred to as a "client" in these terms and conditions.
By using this website, you, the Client, acknowledge that you have read these Terms and Conditions, which will apply to the cooperation between the parties. If you do not agree to these Terms, you should not use this Website.
1. Definitions and interpretation:
1.1. In these Terms, the following words have the following meanings:
"Meeting" means a home visit that you have booked with us for on-site design purposes, with your choice of any design package;
A "business day" is a day (other than a Saturday, Sunday, or public holiday).
"client", "you" means a natural person who requests services offered by Atelier 83 through the Atelier 83 website, or a person authorised to act on its behalf;
"Client Information" means the information and documents, such as floor plans, dimensions, budget, deadline and digital images, etc., relating to the interior that you wish to design or remodel and that we request from you or that we generally require and expect to provide. you provide;
"Client Payments", "Payments" means payments received by Atelier 83 from you;
"Breach" means an event, occurrence or incident in which our performance of any of our obligations under these Terms is prevented or delayed by any of your acts or omissions, or any of your relevant obligations are not met;
"effective date" means the date on which you register on the Atelier 83 website;
"Intellectual property rights" means all patents, inventive rights, utility models, copyrights and related rights, trademarks, service trademarks, trade, company and domain names, goodwill or abuse rights, unfair competition rights, rights to designs, computer software rights, database rights, moral rights, confidential information rights (including know-how and trade secrets) and all other intellectual property rights, registered or unregistered, including all applications and renewal or extension of such rights, and any similar or equivalent rights or forms of protection in any part of the world;
"Price" means the price you have to pay Atelier 83 for the Services;
"Company Atelier 83", "Atelier 83", "we", "us", "our" refers to its representatives, employees and suppliers; and, its agents, employees and suppliers;
"Services" means the services you receive from us;
"virtual design" means an interior design that we develop based on information from the client;
"Website" means the Atelier 83 Website at https://www.atelier83.co.uk or any other domain under our control;
1.2. The following design rules apply in these Terms:
1.2.1. the headings of the Articles and Annexes shall not affect the interpretation of these Terms;
1.2.2. The appendices form part of these Terms and Conditions and will be effective as if they were set forth in full in the text of these Terms and Conditions. Any reference to these Terms also includes the Attachments. References to Articles and Appendices relating to the Articles and Appendices to these Terms;
1.2.3. Unless the context indicates otherwise, words in the singular also include the plural and in the plural also include the singular;
1.2.4. a person includes a natural person, a legal person or an entity without legal personality (whether or not it has a separate legal personality);
1.2.5. the reference to the party includes its personal representatives or successors;
1.2.6. unless the context indicates otherwise, a reference to one sex shall include a reference to the other sexes;
1.2.7. a reference to a law or legal provision is a reference to such a law or legal provision as amended or readjusted. A reference to a law or provision shall also include any secondary legislation issued on the basis of that law or provision as amended or re-enacted;
1.2.8. any obligation of a party not to do anything includes an obligation not to allow the matter to be done;
1.2.9. any phrase introduced by, including, including, but not limited to, any similar expression shall be construed as illustrative and not restrictive of the meaning of the words preceding that expression; and
1.2.10. The reference to the written form or written form includes faxes but not e-mail.
1.2.3. The parties have agreed to enter into these conditions in order to adjust the services provided by Atelier 83 to its clients and have agreed as follows:
2. Beginning and duration:
2.1. Relations between Atelier 83 and clients are governed by these Terms and Conditions with effect from the date of their entry into force.
2.2. We will provide the Website to you under the terms and conditions set forth in these Terms. If you do not agree to these Terms, you should not use the Website.
2.3. Any illustrations, descriptive materials or advertising that we publish, and any descriptions or graphics contained in Atelier 83's promotional materials (including but not limited to any Website) are issued or published solely to provide a rough idea of the services and Services described therein. They will not form part of these Terms or have any contractual force.
2.4. The Terms shall apply to the exclusion of any other terms which the Parties seek to establish or incorporate or which result from trade, custom, practice or conduct.
3. Payment and payment terms
3.1. The website will display information about our services, including the types of services available, our availability, prices and geographic scope, and other relevant data. Prices are in British pounds and are subject to change at any time without notice. Any quoted offer is only valid for thirty (30) days.
3.2. To order our Services, choose one or more online design packages depending on your budget and requirements, enter your personal information when prompted, and then pay. You can also choose optional additional services that are on offer from time to time, although some or all of them may be subject to geographical restrictions. Atelier 83 reserves the right to involve a commercial payment processor for the purpose of receiving and processing payments from clients and other persons and for any custody of funds.
3.3. From time to time, we may publish specifications and requirements on our website for which a standard fee structure for our electronic design services is not available.
3.4. There is no obligation on our part to accept a request for the Services at any time or at all. If we accept such a request, we will contact you and explain the next steps.
3.5. We accept the payment in advance in full and we will start work on your virtual design only after receiving the Payment and all information about the Client. Atelier 83 expects payment within 1 week of the invoice.
3.6. All amounts due to Atelier 83 under these Terms and Conditions are exclusive of value added tax (VAT), as we are not VAT payers.
3.7. You will pay all amounts due to Atelier 83 under these Terms and Conditions in full without any deductions or withholding, and you will not be entitled to make any credit, set-off or counterclaim against Atelier 83 to justify withholding payment of any such amount in whole or in part.
3.8. We occasionally make promotional discounts on online design packages available, but these will not apply retroactively to purchases already made. In addition, these are individual promotions and are therefore intended only for the Client who uses the promotion.
4. Online design service:
4.1 After selecting the online design package, we will contact you and request information about the Client, which you should provide to us by e-mail or through our website. It is your opportunity to specify the required Services in detail. The details we may request include (among other things) the location and size of the relevant rooms or spaces, the number and type of rooms whose interiors are to be designed or remodeled, the style and type (s) of decorations and other aesthetic elements required.
4.2. You warrant and agree that the Client information you provide to us will be sufficient, accurate and complete in all respects.
4.3. Based on the Client Information, the designers then create a Virtual Design, which is a digital design tailored to the room or space. You acknowledge and agree that any Virtual Design we create for you is for illustrative purposes only and is not intended to provide an accurate specification of the interior design project or to guarantee specific results, nor is it necessarily in accordance with the applicable building laws, regulations or guidelines, whether legal or otherwise.
4.4. If a "revision" option is included in the package, it consists of a change to a maximum of five (5) eligible items or items originally selected by the designer. Upon receipt of your revision requests, we reserve the right to request the payment of additional fees before proceeding with further work if we reasonably believe that your request (s) will include a substantive substantive revision of the virtual design.
4.5. Each package offers "design time" with an assigned designer, during which the designer is available via e-mail support and advice or additional telephone support. For the sake of clarity, "design time" does not include other significant design tasks.
4.6. You are obliged to respond to us promptly and in full throughout the design process. If the contact lasts continuously for three (3) months, or if you do not provide us with responses that we deem reasonably satisfactory in helping to advance your virtual design, we will consider your project completed and no further work will be performed and in these circumstances we reserve the right to terminate our services immediately.
4.7. We will offer telephone assistance and it will be possible to contact us by e-mail. The response time will be forty-eight (48) hours from the date and time of the contact or forty-eight (48) hours from the next business day, whichever is later.
4.8. For clarity, if the package contains 3D visualisations of electronic designs, the "revision" eligibility does not include additional 3D visualisations. All such requests will be considered material substantive revisions of the virtual design plan and you will be provided with an offer of additional fees.
4.9. Our proposal may list other third-party products and services that we reasonably believe may help meet your design needs. We provide these recommendations in good faith, but:
4.9.1. without offering or implying any guarantee as to the suitability of the goods or services provided, which is an issue in which you should exercise your due diligence;
4.9.2. we are not liable for any loss or damage or other adverse financial consequences resulting from a breach or failure on the part of the third party - the supplier. You acknowledge and agree that, as regards the supplier and seller, etc. recommended in the Virtual Design Plan, Atelier 83 acts solely as a recommending third party and not as a provider of such stores, goods and services of any kind, and all contractual relationships and arrangements concerning the provision of such trades, goods and services is solely a matter between you and the relevant supplier (s) and / or retailers and others, Dekoroom assumes no responsibility for the provision of such services and you indemnify Atelier 83 in full for the financial consequences of any breach. contracts or breaches of obligations by you or a third party provider in the provision of your services;
4.9.3. Atelier 83 accepts no liability for any incorrect furniture ordered by you or a third party or for furniture that may be incorrectly sized, incorrectly coloured or damaged, whether we ordered it or not.
4.9.4. Atelier 83 works on the assumption that all clients check the dimensions of their recommended pieces of furniture before purchasing. Atelier 83 is not responsible for any furniture you order that does not suit you or that needs to be returned for any other reason. It is your responsibility to inspect any product ordered by Atelier 83 or you to ensure that the ordered products pass freely to the selected room, that it fits in, that it can be transported through all doors, stairs and passages and that there are no other problems, which could complicate delivery or frustrate it;
4.9.5. Although Atelier 83 will use reasonable efforts to ensure that all references to retail products provided to you in the Virtual Design are current to assist you in purchasing the products, there is no guarantee that the furniture or accessories recommended by Atelier 83 will be available for purchase. at all or within the specific time frame you specified for us in your assignment. If prices are listed as part of an electronic design recommendation, there is no guarantee that you will find the product at the same price if you want to order it; and,
4.9.6. we reserve the right to maintain business partnerships and partnerships with these providers of third party goods and services.
4.10. Time is not decisive in providing services under these conditions.
5. Home visit and optional additional services:
5.1. If you choose an additional package that includes a home visit, you acknowledge and agree to the following:
5.1.1. Meetings may be limited to specific geographic areas. You can find current eligibility information on our website.
5.1.2. We reserve the right to refuse the Meeting for any reason or no reason and in these circumstances to refund you in full or in part.
5.1.3. Our home visit option is not a complete interior design service. Although we may make indicative measurements of rooms and spaces, they will be for guidance and illustration purposes only and it will be your responsibility to check, ensure and verify the accuracy of such measurements to your satisfaction.
5.1.4. We will use reasonable efforts to arrange with you and book the Meeting at a time and date that suits you, but we make no warranty. In the event that the Meeting is modified or canceled at your request and despite our reasonable efforts, we are unable to agree on a new date and time, paragraph 6 below will apply.
5.2. If you choose the optional add-on service, you agree that the terms will be as set forth on our website and that they take precedence and amend these Terms accordingly. Subject to the following conditions:
5.2.1. If you choose our home visit service, we will measure your required space (s) with a laser gauge and provide you with floor plans in the scale drawn on our software. These measurements are for information and guidance only and we do not provide or imply any warranty for their accuracy and you should rely on your own care. Atelier 83 designers will endeavor to draw the floor plans provided by you or your supplier with reasonable accuracy. However, Atelier 83 requires you to check that these floor plans are accurate and correct before beginning any form of project work, such as hiring professionals, requesting quotations and purchasing furniture and other items.
6. Cancellation and refund:
You may cancel our Services within fifteen (15) days of the Effective Date by e-mail, in which case the Client's refund will be reduced by an amount that adequately reflects the value of our Services already provided by the date of cancellation. If the cancellation request is received later than fifteen (15) days after the Effective Date, you will not be entitled to a refund.
7. Client reviews:
From time to time, we may ask you to provide quality feedback or evaluation for the Service or both. Upon request, we may anonymize or pseudonymize the Client or otherwise for data protection purposes.
8. Your warranties and obligations:
8.1. You warrant that:
8.1.1. you are over 18 years of age;
8.1.2. you are a human, not a computer service or automated "bot";
8.1.3. you have provided the accurate and valid information required during the package purchase process;
8.1.4. you will only use the Website for lawful purposes;
8.1.5. you will not create, transmit, distribute, or store material that infringes the trademark, copyright, trade secret, or other intellectual property rights of others; violates the privacy, publicity or other personal rights of others; infringes on the privacy of communications; creates obscene, offensive or inappropriate content; causes technical malfunctions of the Website, including, but not limited to, the introduction of viruses, worms or other destructive mechanisms; creates or sends verbal, physical, written or other insults (including insult or retaliation threats) to Atelier 83 or any employee.
8.2. You may not violate any laws in your jurisdiction, including but not limited to copyright laws, when using the Website.
8.3. You are prohibited from attempting to breach the security of the Website or attempting to do so.
8.4. You agree not to reproduce, copy, sell, resell or exploit any part of the Website, use of the Website or access to the Website without the express written consent of Atelier 83.
8.5. You acknowledge that Atelier 83 uses third party vendors and hosting partners to provide the necessary hardware, software, networks, repositories and other technologies necessary to operate the Website. If your bandwidth usage on the Website significantly exceeds the average bandwidth usage of the Website as determined by Atelier 83, we reserve the right to limit your bandwidth on the Website.
8.6. In the event of non-compliance:
8.6.1. Atelier 83 will have the right, without prejudice to its other rights or remedies:
8.6.1.1. suspend your access to the Website until you have removed Atelier 83 Satisfaction Violation; and
8.6.1.2. rely on the Breach to relieve it of any of its obligations to the extent that the Breach prevents or delays the performance of any of its obligations by Atelier 83;
8.6.2. Atelier 83 will not be liable for any costs or losses incurred or incurred by you directly or indirectly as a result of Atelier 83's failure or delay in fulfilling any obligation; and
8.6.3. Upon written notice, you will reimburse Atelier 83 for any costs or losses incurred or to be incurred by Atelier 83 directly or indirectly as a result of the default.
9. Interconnection:
9.1. If you would like to provide a link to the Website or the Website, or both, you may do so only on the basis of a link that does not copy the Website or the Website, and subject to the following conditions:
9.2.1. do not remove, distort or otherwise alter the size or appearance of the Atelier 83 name or logo;
9.2.2. you do not create a frame or any other browser environment or border around the Website / Site;
9.2.3. you do not in any way indicate that Atelier 83 supports products or services other than our own;
9.2.4. you do not provide false information about your relationship with Atelier 83 or any other false information about Atelier 83;
9.2.5. you do not otherwise use the Atelier 83 name or any trademarks displayed on our website / website or any other services we may provide without the express written consent of Atelier 83;
9.2.6. you do not link from a website that is not owned by you; and
9.2.7. your website does not contain content that is annoying, offensive or controversial, infringes the intellectual property rights or other rights of others, or otherwise does not comply with all applicable laws and regulations.
10. Intellectual property rights:
10.1. In the relationship between Atelier 83 and the Client, all intellectual property rights that are part of or result from the Website or are associated with it are the property of Atelier 83. Subject to clause
10.2 below, Atelier 83 grants the Client a non-exclusive worldwide license to all such rights to the extent necessary to enable you to make appropriate use of the Website and our Services, subject to certain third party rights. For example, photos of products used in mood signs are protected by the copyright of their respective owners. If our Services are canceled or terminated, this license will automatically terminate.
